KernbegriffCore term

AufsichtshandlungOversight act

Whenever a person was “involved” with a machine, this term records what exactly they did: looked, checked, decided or released.

Kennst du das?Ever had this?

At a parents' evening what counts is not that you were in the room, but what you did: listened, looked something up, voted or allowed something. With machines it is the same – “was there” is not enough.

DefinitionDefinition

An act of a natural person that is directed at an output, action, state, or class of actions of a system and that is recorded, or is meant to be relied on, as human involvement in the operation of that system.

Was es nicht istWhat it is not

Unlike “human in the loop” or “human oversight” as a general requirement (e.g. Regulation (EU) 2024/1689, Art. 14), an oversight act is one stored act of a natural person of one of four kinds; presence, a schedule or a tool verdict is not one. In English, “oversight” also means an inadvertent omission; that sense is not meant.

Source: individual Internet-Draft draft-ehstand-oversight-acts-00 (work in progress; not an IETF standard or IETF consensus document; no IETF standards status), Section 2.1. Relevant where regulation requires human oversight (e.g. Regulation (EU) 2024/1689, Art. 14(4), which lists oversight capabilities such as disregarding, overriding or interrupting a system) but does not prescribe how an individual oversight act is recorded. Internet-Drafts have no IETF standards status and are not endorsed by the IETF. Using this term does not establish conformity with Art. 14. Records that identify an overseer are personal data; where overseers are employees, such records can monitor behaviour or performance and need a legal basis under GDPR Art. 6 and Art. 88 and, in Germany, co-determination under BetrVG § 87(1) No. 6. The record exists to document the oversight act, not to evaluate the overseer.
